How to Avoid Getting Burned by an Offshore Development Agency

Offshore development can save you money and deliver quality—or it can burn you. Here’s how to reduce the risk.
Before you pay, get a written scope: features, screens, “done” criteria, and what’s out of scope. Both sides sign it (or acknowledge by email). When “we need one more thing” comes up, you have a baseline: either it’s in scope or it’s a change request with a quote. Scope creep without a process is how projects blow up. Don’t start work until scope is agreed.
Don’t pay 50% or 100% upfront. Split into milestones (e.g. design approval, alpha, beta, launch). You pay when you sign off on each. If they don’t deliver a milestone, you don’t pay for it—and you have a natural exit. Good agencies are fine with this; those that insist on big upfront payment are a red flag.
Contract should say: all code and design are yours (on delivery or on final payment). You get repo access and assets. If they say “we keep the code until you pay in full,” that’s okay only if “pay in full” is tied to a clear deliverable and you’re not locked in forever. Never agree to “we own the code and license it to you” unless you’re okay with that. Walk away if they refuse to assign IP to you.
Ask for 2–3 similar projects (links or case studies) and 1–2 client references. Call the references: Did they deliver? On time? Would they use the agency again? If the agency can’t provide proof or references, that’s a risk. So is pressure to “sign today” or skip the contract.

- Promises that sound too good (“full app in 2 weeks for $3K”).
- Clear scope, milestones, and contract.
- Willingness to do a small paid pilot.
- Concrete past work and references.
- Responsive communication and a single point of contact.
